Terms of Use
By using CloudClinic, you agree to these terms. If you are a licensed physician, Section 2 is the most important section — please read it carefully.
1.About CloudClinic
CloudClinic is a clinical documentation and workflow platform for licensed Philippine physicians. It helps doctors generate, manage, send, and archive medical documents — prescriptions, medical certificates, DDE assessments, referral letters, laboratory requests, and related clinical paperwork.
CloudClinic is a documentation tool only. It does not provide medical advice, clinical diagnosis, or treatment recommendations. It has no ability to review, approve, or override any clinical decision made by the physician using it.
By accessing or using CloudClinic, you agree to these Terms of Use. If you do not agree, do not use the platform.
2.Physician Responsibility — Clinical Decisions
CloudClinic is a documentation instrument. Every clinical decision — diagnosis, treatment, prescription, assessment, and any content in any generated document — is the sole and exclusive professional and legal responsibility of the licensed physician who inputs that information and issues that document.
Specifically, the physician using CloudClinic is solely responsible for:
- All prescription content. The selection of medications, dosages, quantities, administration instructions, contraindication screening, and drug interaction review are the physician's clinical judgments alone. CloudClinic renders prescription items exactly as the physician enters them — it does not screen, validate, or modify any medication entry.
- Generic drug naming compliance (RA 6675). Under Republic Act No. 6675 (Generics Act of 1988), prescriptions must carry the generic name of the drug. CloudClinic's prescription template is designed to display the generic name prominently. The physician is solely responsible for ensuring that every medication entered in a prescription bears the correct generic name. Brand names, if used, are the physician's optional choice — CloudClinic does not add or promote any brand name.
- Controlled and dangerous drug prescriptions. For substances regulated under RA 9165, S2 prescriptions, or any drug requiring special regulatory handling, the physician is solely responsible for complying with all DDB, DOH, and PRC requirements.
- DDE assessments and reports. All clinical findings, conclusions, and certifications in DDE reports are the sole professional judgment of the issuing physician. CloudClinic generates the document format — the clinical content is exclusively the physician's responsibility.
- Accuracy of all document content. Every piece of information entered — patient data, clinical notes, diagnoses, findings, dates, credentials, license numbers — must be accurate. The physician is responsible for the accuracy of all content in any document they generate and issue.
- Document issuance decisions. The decision to issue, email, print, or transmit any document to any party is the physician's decision alone.
CloudClinic does not review, supervise, audit, endorse, or take responsibility for any clinical act performed through the platform.
3.Who May Use CloudClinic
CloudClinic is intended for licensed physicians registered with the PRC of the Philippines and authorized clinic staff operating under the direct supervision of a licensed physician with a CloudClinic account.
By creating an account, you represent that you hold a valid, active PRC license (physician accounts), or that you are authorized by the supervising physician (staff accounts), and that you will use the platform only for lawful clinical practice purposes.
4.Prohibited Use
You may not use CloudClinic to generate documents for patients you have not examined, issue prescriptions for substances you are not legally authorized to prescribe, create false or fraudulent medical records, or circumvent any regulatory requirement applying to your clinical practice. Violations may result in account suspension and referral to the PRC, DDB, or DOH.
5.Service Availability
CloudClinic is provided on an "as is" basis. We do not guarantee uninterrupted operation and may temporarily suspend access for maintenance or security reasons. Do not rely on CloudClinic for emergency clinical situations. If the platform is unavailable, use manual documentation methods to ensure continuity of patient care.
6.Data and Privacy
Your use of CloudClinic is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Clinics operating CloudClinic for staff access are also subject to the CloudClinic Clinic Data Processing Agreement (DPA). To request a copy, email cloudclinic.ph@gmail.com.
7.Limitation of Liability
To the maximum extent permitted by Philippine law, CloudClinic is not liable for any clinical outcome, patient harm, or adverse event arising from any clinical decision made by a physician using the platform. CloudClinic is not liable for platform unavailability or data loss due to device failure. CloudClinic's total aggregate liability is limited to amounts paid in the twelve months preceding the claim. Nothing limits liability for gross negligence, willful misconduct, or personal data breaches caused by CloudClinic's own failure.
8.Changes and Governing Law
We may update these Terms and will notify registered users of material changes by email. Continued use after the effective date of an update constitutes acceptance. These Terms are governed by the laws of the Republic of the Philippines.
